1. Description of the Activity
Walk & Talk is a conference format offered as part of the Serious Play Conference Europe.
Participants meet with a speaker at the conference venue and subsequently leave the venue as a group for a guided walk and discussion in nearby public areas, including pathways and public spaces along the Rhine River (Rhein). After the discussion, the group returns to the conference venue.
Participation is voluntary.
2. Participation Requirements
Participants are responsible for assessing their own physical condition, health and suitability for participation.
By participating, individuals confirm that they are able to take part in a walk of the announced duration and that no medical, physical or other condition prevents them from participating safely.
Participants agree to comply with applicable laws, traffic regulations and reasonable instructions provided by the organizer or session facilitator.
3. Assumption of Risk
Participants expressly acknowledge that the Walk & Talk session takes place outside the conference venue in public spaces and includes areas located near the Rhine River.
Participants understand that participation may involve risks, including but not limited to:
• Slips, trips and falls
• Uneven, wet or damaged surfaces
• Traffic, bicycle traffic and other public transportation hazards
• Weather conditions including rain, wind, heat and other environmental influences
• Physical exertion associated with walking
• Risks associated with proximity to the Rhine River and waterfront areas
• Actions of other participants or members of the public
• Loss, theft or damage of personal belongings
Participants voluntarily assume all risks associated with participation in the Walk & Talk session.
Each participant is solely responsible for their own safety, health, conduct and personal belongings throughout the activity.
The organizer does not provide medical supervision, water safety supervision, lifeguarding services, transportation services or personal accident insurance.
Participants are expected to exercise appropriate caution at all times and to maintain a safe distance from the river and any potentially hazardous areas.
Participation is entirely at the participant’s own risk.
4. Liability
To the maximum extent permitted by law, participants acknowledge that Mind Games GmbH acts solely as the organizer of the activity and does not assume responsibility for risks that are inherent to participation in an outdoor walking activity in public spaces.
Participants are responsible for any injury, loss, damage or other consequences arising from their own actions, omissions, decisions, health condition or failure to comply with applicable laws or reasonable instructions.
Mind Games GmbH shall not be liable for loss of personal property, theft, accidents, injuries or damages resulting from ordinary risks associated with participation in the activity, except where liability is required by law.
Nothing in these Terms excludes or limits liability for:
• Intentional misconduct
• Gross negligence
• Injury to life, body or health
• Any liability that cannot legally be excluded under applicable law
5. Loan of Headsets and Equipment
Participants may receive a headset, receiver or related equipment for use during the session.
The equipment remains the property of Mind Games GmbH at all times.
Participants agree:
• To handle the equipment with reasonable care
• Not to transfer the equipment to third parties
• To return the equipment immediately after the session
Participants may be held responsible for repair or replacement costs in the event of intentional damage, loss or damage resulting from grossly negligent handling.
Participants who fail to return borrowed equipment may be invoiced for the replacement cost of the equipment.
6. Photo, Video and Audio Recordings
Photographs, video recordings and audio recordings may be created during Walk & Talk sessions.
Such recordings may be used for event documentation, reporting, public relations, marketing and promotion of the Serious Play Conference Europe and future editions of the event.
Participants who do not wish to appear in recordings must inform the organizer before the session begins. The organizer will take reasonable measures to exclude such participants from future recordings wherever practicable.
Further information can be found in the Conference Photo, Video and Audio Recording Notice.
7. Cancellation or Modification
Mind Games GmbH reserves the right to modify, postpone, relocate or cancel a Walk & Talk session at any time due to safety concerns, weather conditions, speaker availability, force majeure or other operational reasons.
8. Governing Law
These Terms shall be governed by the laws of the Federal Republic of Germany.
Should any provision of these Terms be invalid or unenforceable, the remaining provisions shall remain unaffected.
By signing the Walk & Talk Participant List, participants confirm that they have read, understood and accepted these Terms and Conditions and voluntarily agree to participate in the Walk & Talk activity.
